CCPA Compliance For Law Firms That Advertise On Facebook and New Limited Data Use Feature.

Quick version: Facebook just released a Limited Data Use feature to give businesses more control over how their data is used in the systems and better support them with their CCPA compliance efforts. Starting July 1, 2020, advertising law firms may see the impact to test results reporting for individuals in California.

CCPA and Facebook Marketing:

California Consumer Privacy Law (CCPA) is a new California law that protects people from unauthorized use of their personal information by businesses and provides for $100 – $750 in statutory damages per violation. It gives people control over what information is being collected on them and how it can be used.

Does CCPA Apply to my Law Firm?

CCPA generally applies to any company doing business in California that collects, shares, or sells California consumers’ personal data, and:

  • Has annual gross revenues in excess of $25 million; or
  • Possesses the personal information of 50,000 or more consumers, households, or devices; or
  • Earns more than half of its annual revenue from selling consumers’ personal information.

What Do I Need to Know about a Limited Data Use Feature Released by Facebook?

Facebook released a Limited Data Use feature to give businesses more control over how their data is used in the systems and better support them with their CCPA compliance efforts. Starting July 1, 2020, advertising law firms may see the impact to test results reporting for individuals in California.

Advertising Law Firms may choose to enable the Limited Data Use feature and update default settings for Limited Data Use in Events Manager and Monetization Manager.

According to Facebook, “[w]hen a business enables Limited Data Use, Facebook will process data in accordance with our role as a service provider with respect to flagged personal information from people in California, and limit use of that data subject to our State-Specific Terms. When Limited Data Use is enabled, a business may notice an impact to campaign performance and effectiveness. Additionally, retargeting and measurement capabilities will be limited.”
